TERMS & CONDITIONS – MEDICAL/CHARTER FLIGHTS Aircraft - KING AIR C90 A || PT6A-21 ENGINE

The terms “We” / “Us” / “Our”/”Company” individually and collectively refer to Flyus Airways Pvt.Ltd and the term “USER” refer to the USERs/clients/agents/passenger/patient.

  1. FLYUS shall provide the said aircraft on hourly basis for charter & medical purposes.
  2. The hourly rates offered shall exclude Ground handing charges, permissions, watch hours, landing & parking charges, night parking charges & GST as maybe applicable.
  1. FLYUS shall charge a net amount inclusive of aircraft flying charge ,medical escort team if applicable, ground handling and other logistic cost involved for medical charters.
  1. All costs are estimated & based on distance and approximate cruising speed of the aircraft in nil wind conditions. Any delay/diversion due to bad weather or refueling purpose, VVIP/VIP flight, unserviceable runway etc. has not been taken into consideration. The final invoice will be based on actual Block Flight Time (measured from “Engine On” to “Engine Off”) and aircraft waiting period on ground.
  1. The costs include Aircraft Rental, Crew Salaries, Maintenance, Insurance, Fuel Costs, In-flight catering, Route Navigation Charges.

6 .The responsibility to Air Lift the patient will finally rest with FLYUS and neither the client / Patient attendant nor third party would impose this decision, in the best interest of the patient care and safety.

  1. That FLYUS and/or the pilot may refuse to allow any attendant, baggage inside the Aircraft and/or de-board such baggage and/or passenger in case the pilot in his sole discretion deems it fit and proper for the safety of the flight and/or in case the total payload weight exceeds the permissible limit.
  1. Additional therapeutic oxygen & wheelchairs can be provided on client’s request subject to availability.
  1. In the event where the condition of patient is not fit to fly at the time of embarkation or has any significant variation in the physical condition than the details provided, carriage may be refused. In any case, the patient and/or the Flight, Aircraft, will not be accepted where it may jeopardize the safety, security or operation of aircraft/passenger/crew/cargo. That FLYUS shall not be liable to provide any reasons for cancelling such flight.
  1. That FLYUS shall not be responsible in case of any diversion and/or delay in the flight which may be caused for any reason whatsoever which is beyond the control of FLYUS (including but not limited to permission from ATC/Airport Authorities, cancellation of any such permission, weather conditions, security reasons etc.
 

Flight Activation

  1. The payment has to be made in advance (full 100%) before the scheduled departure take place. FLYUS would provide no credit period to any USER for the payment .
  1. Payment has to be made in the Name of “FLYUS India Private Limited.” as Cash / Bank A/C / Online Transfer / Debit Card / Credit Card. If the payment is made by corporate/ Proprietary/Company or any other firm the TDS of 2% under section 194/C has to deducted by the client and same should be deposited to TDS department
  2. FLYUS will confirm medical evacuation/charter flight only after the full payment is received by FLYUS India Private Limited.
  3. Documents required for the activation of Medical flight -
  • Fit to Fly Certificate
  • Discharge Certificate
  • Medical summary
  • RTPCR if applicable
  • Indemnity Form
  1. Documents required for the activation of Human remains -
  • Death Cerificate
  • Embalming certificate
  • NOC from Local Police station
  • Coffin Certificate
  • ID proof of sender
  • ID proof of receiver
  • ID proof of the deceased person
  • Embassy letter and cancelled passport ( Intl transfers)
  1. The Flight shall be active within 02 hours for domestic and 12 hours for International departure/arrival upon receiving the payment to FLYUS AIRWAYS India Pvt. Ltd. via any mode.
  2. It is the sole responsibility of Client/Agent to ensure that the payments for Charter / Medical Evacuation flights are received from the Patient/Passenger.
  3. Flights are subject to availability of Aircraft, Airworthiness and Weather Condition.
  1. In case, if the flight has to be diverted to some other sector(s) due to bad weather or other technical reason(s) or due to non- availability of the parking space or for refueling at the destination airport or due to non- availability of the night parking facilities at the destination airport, the client would bear the cost of the additional sector/s and Hours flown along with crew accommodation and lodging.
 

PARTNER activation

  1. The PARTNER may purchase the hours under Executive category or Medical Category respectively.
  1. FLYUS requires 72 hours prior flight request to undertake Executive charter request and to ensure flight availability.
  1. FLYUS shall provide credit of requested flight hours to its PARTNER /s in the event of non-availability of the said aircraft for executive charters only.
  1. In the event of medical charter under Pre-purchased hours/flights FLYUS shall provide aircraft based on aircraft availability.
  1. FLYUS shall provide credit of requested flight hours to its PARTNER /s in the event of non-availability of the said aircraft for Medical charters.
  1. In the event a PARTNER/S pre-booked on Executive charter wishes to cross utilize the purchased hour for medical flight or vice versa may do so, subject to availability. Any non- availability of such flights shall not attract any reimbursement/credit of hours. (i.e Partner X pre-booked 20 hours of medical charter flying, wishes to book executive charter and requests 72 hours for confirmation, whereas the aircraft cannot be made available, In such event the PARTNER shall not be eligible to ask for reimbursement /credit of hours).
  1. In the event of Pre-purchased hours/flights PARTNER needs to send an email confirmation to FLYUS to activate the requested flight, post confirmation on availability by FLYUS.
  1. The Flight for PARTNER shall be considered activated only post receiving the email confirmation. Once confirmed, the flight shall be not be considered cancelled for any controlled reasons.
  1. In the event of such cancellation post confirmation, the said block hours shall be deducted from the PARTNER’s pre-purchased hours
  1. FLYUS reserves the right to accept activation/cancellation at any given time.

INDEMNITY

  1. USER agrees that the liability of FLYUS shall be limited to the extent that is covered / indemnified by the Insurance Company under the Insurance policy taken for the particular Aircraft and is satisfied with the insurance policy of the Aircraft. Any other tax levied or payable on the date of the flight shall be borne by the Patient or their relatives.
  1. The USER unilaterally agree to indemnify and hold harmless, without objection, the Company, its officers, directors, employees and agents from and against any claims, actions and/or demands and/or liabilities and/or losses and/or damages whatsoever arising from or resulting from their use of FLYUS services or their breach of the terms.

FORCE MAJURE

  1. FLYUS does not hold itself responsible for non-operation of charter for any unforeseen reason/s such as
  1. Bad Weather
  2. Poor Visibility
  3. Non Availability of clearances from ATC / Defense Authorities / Civil Administration
  4. Technical Problem.
  1. FLYUS is not responsible if any technical snag developed in the aircraft which cannot be rectified within the time limit and effect the flight operation.
  1. Baggage Restrictions: Medium Size baggage are allowed with a dimension of HEIGHT: 26 INCHES / 67 CM & WIDTH: 18 INCHES / 45 CM on board.

REFUNDS & CANCELLATIONS

Refunds Policy

Our focus is complete customer satisfaction. In the event, if you are displeased with the services provided, we will refund back the money, provided the reasons are genuine and proved after investigation. Please read the fine prints of each deal before buying it, it provides all the details about the services or the product you purchase. Our refunds process initiation period is 7-10 Business working days. Refunds will be processed on the same medium it was paid by. All the refund-related queries will be resolved with proper investigation and situational analysis.

We will try our best to create the suitable design concepts for our clients.

If paid by credit card, refunds will be issued to the original credit card provided at the time of purchase and in case of payment gateway name payments refund will be made to the same account.

In case of dissatisfaction with our services, clients have the liberty to cancel their bookings and request a refund from us. Our Policy for the cancellation and refund will be as follows:

General Cancellation Policy

  1. After Confirmation ————- 10% of total charter cost
  2. 12 – Hrs before flight ——- 25 % of total charter cost
  3. No Show ———————— 100 % of total charter cost
  4. Cancellation done after departure from Base Station, No Refund will be given.

Partner’s Cancellation Policy

  1. After Confirmation ————- 50% Block hours of total charter.
  2. No Show ———————— 100 % Block hours of total charter.
  3. Cancellation done after departure from Base Station, No Refund will be given.
  1. The full amount other than Airport charges paid in advance to the authorities at uncontrolled Airstrips, Helipads etc. & the Fuel positioning charges will be refunded if the flight cannot take off from the Originating station due to ant reason/s as stated under force majure clause of this agreement.
  2. We always obtain the destination weather before departure. However, if due to sudden deterioration of weather en-route /destination, the aircraft cannot land at the Destination and has to return to the starting point or divert to some other airport, the actual flying time would be chargeable and balance if any would be payable / refundable.
